Tesla Sues U.S. Government Over Tariffs On Chinese Imports

Tesla is suing the U.S. authorities because of the Trump government ’s tariffs on several different items which Tesla imports from China.

A lawsuit filed at the U.S. Count of International Trade targets the authorities and U.S. Trade Representative Robert Lighthizer, taking issue with all the tariffs known as List 3 and List 4. Tesla desires the court to obtain these two batches of tariffs to be void.

List 3 went in to effect in 2018 and puts 25 percent duties on $200 billion worth of imported goods from China. List 4 includes a 7.5 percent tariff on $120 billion of Chinese prices also went into effect in 2019. The lists include a huge number of specific items, but the lawsuit doesn’t explain the exact elements that Tesla is paying tariffs on, CNBC reports.

In the filing, Tesla’s attorneys argue the U.S. trade agent ’s “imposition of List 3 and List 4 responsibilities was arbitrary and capricious because USTR did not provide meaningful opportunity to comment, didn’t consider important factors when making its choice, and neglected to draw a rational connection between the facts found and the choices made. ”

The Trump government allowed firms to submit an application for a waiver to the Chinese tariffs. Tesla applied and have been granted waivers for synthetic graphite, carbon dioxide , and door ring tailor welded blanks. The waiver for these items expired on August 2020.

The U.S. automaker also applied for a waiver by the 25 percent tariff on the Model 3’s computer and infotainment screen. U.S. trade officials rejected the petition, claiming the parts use technology tactically important to Chinese domestic security applications.
